1. Acceptance of Terms

By accessing or using the Trusted James platform, purchasing lead packages, or submitting an application, you (“Client,” “Agent,” or “User”) agree to be bound by these Terms & Conditions.

If you do not agree, do not use the Platform.

2. Description of Services

Trusted James is a lead generation platform that provides exclusive, opt-in consumer inquiries to licensed insurance professionals in the following verticals:

Indexed Universal Life (IUL)

Final Expense (FEX)

Mortgage Protection (MP)

We sell qualified consumer inquiries (“Leads”), not guaranteed appointments, sales, policies, or revenue.

3. No Performance Guarantee

Trusted James does not guarantee:

Appointments

Policy approvals

Closed sales

Revenue

Return on investment

Lead performance depends on factors including but not limited to:

Speed of follow-up

Sales process

Close rate

Market conditions

Underwriting approval

By purchasing Leads, Client acknowledges that results vary and are not guaranteed.

4. Lead Definition

A “Valid Lead” is defined as a submission that includes:

Contact details (name + phone)

OTP-verified phone number

Completed qualification survey

Consumer consent to be contacted

Within selected product category

Within selected geographic territory

A Lead is NOT invalid because:

The consumer does not answer

The consumer does not close

The consumer lacks funds

The consumer changes their mind

The consumer is declined in underwriting

The consumer previously requested information elsewhere

5. Lead Review Policy

Client must request review of a disputed Lead within 2 business days of delivery.

After this period, the Lead is deemed accepted.

If a Lead is determined invalid under Section 4 criteria:

The Lead will be replaced or credited toward future volume.

No cash refunds will be issued.

All review determinations are made at Trusted James’ sole discretion.

6. Exclusivity

Leads are exclusive at the time of delivery.

Trusted James does not knowingly resell the same Lead to multiple clients simultaneously.

However, exclusivity does not prevent:

Consumers from independently contacting other providers

Consumers from submitting information to multiple websites

7. Payment Terms

All lead packages are prepaid.

Pricing varies by vertical and volume.

By purchasing, Client agrees to:

Authorize payment

Accept automatic monthly renewal (if applicable)

Auto-renew may be canceled up to 3 business days prior to renewal date.

No refunds are provided for unused Leads once delivered.

8. No Ad Spend Required

Trusted James manages acquisition, advertising, and marketing internally.

Client does not manage advertising accounts or media budgets.

Client acknowledges that they are purchasing Lead volume, not advertising services.

9. Client Responsibilities

Client agrees to:

Maintain active insurance licensing

Comply with all applicable federal and state laws

Follow TCPA regulations

Conduct lawful follow-up

Maintain consumer confidentiality

Not harass or misuse consumer information

Trusted James reserves the right to terminate access for violations.

10. Data Usage & Ownership

Lead data remains part of the Trusted James platform ecosystem.

Client receives a limited, non-transferable license to use Lead information solely for:

Contacting the consumer

Offering relevant insurance products

Client may not:

Resell Leads

Transfer Leads

Publish Lead data

Use data for unrelated marketing

Unauthorized use may result in termination and legal action.

11. Volume Caps

Trusted James may limit:

Monthly Lead volume

Geographic availability

Client onboarding

We reserve the right to deny service to maintain system stability and quality.

12. Termination

Trusted James may suspend or terminate services if:

Payment fails

Licensing cannot be verified

Client violates these Terms

Client engages in abusive behavior

Termination does not entitle Client to refunds for delivered Leads.

13. Limitation of Liability

To the maximum extent permitted by law:

Trusted James shall not be liable for:

Lost profits

Business interruption

Indirect damages

Consequential damages

Total liability shall not exceed the amount paid by Client in the preceding 30 days.

14. Indemnification

Client agrees to indemnify and hold harmless Trusted James from any claims, damages, or legal actions arising from:

Client’s use of Leads

Violations of law

Consumer complaints

Improper contact practices

15. Independent Relationship

Trusted James is not an employer, broker-dealer, or agency partner.

Client operates as an independent contractor responsible for their own licensing, compliance, and sales process.

16. Modifications

Trusted James may update these Terms at any time.

Continued use of the Platform constitutes acceptance of updated Terms.

17. Governing Law

These Terms shall be governed by the laws of [Insert State].

Any disputes shall be resolved in the courts located within that jurisdiction.
